Death of a bad guy

Enron ogre Kenneth Lay died this morning in Aspen. The cause printed in the N.Y. Times was a heart attack, which it may have clinically been. Of course, the dramatist in all of us can't help but imagine-presume that what really brought his curtain down -- a combination of stress, the shame-horror of doing prison time and, of course, not wanting to die in jail.

Lay was found guilty several weeks ago on six counts of fraud and conspiracy and four counts of bank fraud, and was looking at a very long sentence, and having lived a cushiony lifestyle for so long, he must have been filled with dread at what lay ahead.

I don't mean to sound heartless about this, but Lay was one of the most heartless corporate pricks of all time, a major conniver whose venal spinnings and maneuver- ings resulted in the ruining of many lives. Take a look sometime at Alex Gibney's Enron: The Smartest Guys in the Room and tell me I'm wrong. If anyone deserved the label of "bad guy," it was certainly Kenneth Lay.

So let's be honest and admit that Lay's death this morning is dramatically satis- fying. If anything he got off easy. Aspen is a very beautiful and soothing place and a good place to breathe in mountain air, lie down, close your eyes and bid farewell. A better point of departure, certainly, than some prison cell in some federal facility.

For some reason I'm thinking of that moment in Casablanca when Ingrid Bergman laments that if Humphrey Bogart's Rick doesn't help Victor Laszlo by selling him the fabled "letters of transit" that he'll die in Casablanca, and Bogart snaps, "So what? I'm gonna die in Casablanca. It's a good spot for it."

Ken Lay was certainly heartless -- and where exactly did all that money go? -- but Jeffrey Skilling is even worse (far worse), in my opinion. Whereas Ken Lay had no moral compass whatsoever, Skilling is an arrogant, egotistical slimebag...with no moral compass.

You may be right about the level of prickdom re: Lay, but I can't point to E:TSGITR as proof of this. From that doc, Skilling appeared to be the one stealing the keys to the car, and Lay was more like the parent with his head in the sand.

i would bet, however, that the situation was more like organized crime, with Lay as the Godfather, who always kept his nose clean, only revealing his full ruthfulness behind closed doors. Lay was the righthand man, and Fastow was the pitbull.

Anyone else think the same thing - "My Aunt's Fanny it was a NATURAL heart attack."

However, if I read the verdict reports right, Lay - who hadn't been sentenced yet - might have only seen something like 5 years behind bars. The estimates of what the full sentence would be (20-30 years) never mention the minimums. So, it probably was the stress of the trial plus the news the Feds were going after more money he had hidden away in back accounts while claiming "poor-mouth."

Yeah, because all of us poor folks vacaction in Aspen.

I just wonder how many people who are being flippant about his death are rabid anti-death penalty nuts. Being glad someone is dead is being glad someone is dead, no matter how you cut it.

Many of us are against the death penalty because we know that it is almost certain that innocent Americans have been killed because of the flaws in the legal system if not for downright fraud on the part of prosecutors.

Death penalty fans seem to live in a world where they would rather see innocent people put to death in order that the guilty suffer. My moral code says it is far better that some guilty go free so that the innocent are murdered by their state.

I get a chuckle, however, when mother nature steps in to correct the situation.

I think the reason there are people who are against the death penalty is because if Ken was poor and black, he'd be more likely to be accused of murder/rape and executed. Capitalism? It's the only system that does indeed work. Using a a corrupt business man like Lay as proof of a broken system is a copout. Actually it's proof of how good our system works when men like Lay are found guilty and sentenced. The truth is that capitalism motivates people. Go to an inner city school and try to teach the kids there about the hardships of the human condition and see how much they'll want to learn; teach them about how to get ahead in the world through self-motivation, ethics and a how to make a good living and you'll see much more positive results. Leave the hardships of the human condition to the artists who thrive on it for creative motivation.

The difference is that I've also read "Conspiracy of Fools," the book by NY Times reporter, Kurt Eichenwald (sp?), which catalogues in spectacular detail the rise and fall of Enron. That book makes it pretty clear that Lay was mostly a deluded, not very thorough, and just plain bad executive who delegated a ton of authority to Jeffrey Skilling and Andy Fastow and then failed to heed warning after warning regarding their mismanagement. Lay was not a bad guy. He was incompetent to be sure, but I don't think he even deserved to go to jail, much less die, for that. Also, as "Conspiracy" makes clear, all those Enron employees who lost their jobs and their 401-K's were similarly incompetent in the manner in which they continued to put all their eggs in Enron's basket even after Enron's crash was well under way. And don't forget the incompetence of all the American investors who drove up the Enron stock price and then cried foul when it crashed. All those investors were just plain silly for putting so much of their money in a company that never explained what the heck its business was. Good investors know better than to invest in a company like Enron, a company that never revealed the particulars of how it made its money.

"Good" investors are paid to inflate the value of companies like Enron in order to coerce the "bad" investors into investing in those companies. Again, that's why the system doesn't work, because people are investing other people's money, instead of their own.

NYCBusybody - you may say you are a Dem but you have certainly adapted the Karl Rove method of 'arguing' your points by attacking your 'opponent'.

That said - sticking a serious criminal in jail for life is hardly the same thing as letting them off scott-free with a pat on the back and a new suit of clohtes. The main reason to be anti-death penalty is because one is anti-murder. To kill an unarmed and defenseless person (no matter how many terrible things they have done in the past) in cold blood is in my book - murder (as opposed to killing someone in the active process of attacking you).

I think it is the hallmark of a 'civilized society' not to act like bloodthirsty as*holes, but clearly, many Americans disagree.

BTW, NYCBusybody, if you haven't already, you should start picking up the NY Press - I think Armond White (one of the film reviewers there) might be right up your alley.
